These Terms & Conditions apply to the website, programs, services, and digital products offered by Sally Barker and Peak Performance HypnoCoaching (“we”, “us”, or “our”). Please read them before purchasing or participating. Any specific program or private coaching agreement provided before purchase should be read alongside these terms.

1. Our services

Sally Barker is a Mental Conditioning Coach. Our services include coaching and hypnosis-based programs, digital courses, workshops, guided audio, written resources, and The Mind Mastery Guild. They are designed for education and personal and professional development.

Services and resources may be delivered through Systeme.io, Skool, email, private client portals, video-conferencing, or another platform identified in the relevant offer.

2. Purchases, payments, and ongoing programs

The applicable price, currency, payment arrangements, and inclusions are those disclosed in the offer, checkout, or written agreement before you purchase. Please check them carefully and contact us if anything is unclear.

Where an offer involves recurring payments, a minimum commitment, or instalments, the billing frequency, commitment, and cancellation arrangements must be disclosed before you agree. An instalment plan for a fixed program is different from a month-to-month membership. Your individual offer or agreement sets out which arrangement applies.

Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

3. Digital products and access

Access details are provided by email or through the platform identified in your purchase. Contact us if you do not receive them or have technical difficulties.
Your purchase provides personal, non-transferable access for the period stated in the offer. Sharing login details, distributing content, or reselling access is prohibited unless we have agreed otherwise in writing.
Any access period, downloads, platform requirements, and product-specific conditions are those disclosed before purchase.

4. Coaching appointments and live sessions

Private coaching appointments must be booked in advance.
Please provide at least 24 hours’ notice to reschedule. A missed appointment or cancellation with less notice may be forfeited under the arrangement agreed when booking, subject to your statutory rights.
Any additional scheduling, transfer, or program-specific arrangements are set out in your individual agreement.
Coaching is collaborative. Participation and practice influence the experience, and individual results vary.

5. Refunds, cancellations, and transfers

Your Australian Consumer Law rights

Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If a product or service does not meet an applicable consumer guarantee, you may be entitled to a remedy, which may include a repair, replacement, refund, cancellation, or compensation, depending on the circumstances. The change-of-mind policies below do not limit those rights.

Digital products and self-paced programs: We do not offer change-of-mind refunds once access has been provided, unless the particular offer states otherwise. This does not affect any refund or other remedy you are entitled to by law.
Live workshops and programs: Change-of-mind refund requests may be considered where cancellation is requested at least 48 hours before the event begins. Any specific cancellation policy disclosed in the offer also applies, subject to your statutory rights.
Private coaching: Subject to your statutory rights, payments for coaching sessions or packages are not refundable for a change of mind. Transfers or rescheduling may be available within the agreed timeframe.

If we cannot provide a paid product or service as agreed, we will discuss the appropriate remedy with you, including a refund where required. For a refund request, access problem, or other purchase issue, email admin@sallybarker.com.au with your purchase details.

6. Intellectual property

Our original recordings, course materials, written resources, videos, and program content remain the intellectual property of Sally Barker and Peak Performance HypnoCoaching, or their respective rights holders.

You may use the materials for your own personal learning. Copying, modifying, sharing, selling, or using them commercially requires prior written permission, except where otherwise permitted by law.

7. Health and safe participation

Our coaching, hypnosis, and educational resources are not a substitute for medical or psychological advice, diagnosis, or treatment. They do not replace care from an appropriately qualified health professional.

If you have a diagnosed medical or mental health condition, we require written consent from your treating physician or appropriately licensed healthcare provider before participation.

Use guided hypnosis and relaxation recordings only in a safe place where you can rest without needing to remain alert. Do not listen while driving, operating machinery, or doing another activity that requires your full attention. Stop an experience if you become uncomfortable and seek appropriate professional advice where needed.

8. Results and disclaimer

We do not guarantee a particular outcome from coaching, a program, a recording, or a resource. Results depend on individual circumstances and participation. Examples, stories, and testimonials describe particular experiences and do not promise the same result for everyone.

Educational information should be considered in the context of your own circumstances. Seek appropriate medical, psychological, legal, financial, or other professional advice where a decision requires that expertise.

This website and our programs are independent of Meta Platforms, Inc. and are not endorsed by Facebook or Instagram. References to third-party platforms do not imply that those platforms endorse our services.

These disclaimers do not exclude, restrict, or modify any consumer guarantee, duty, or liability that cannot lawfully be excluded.

9. Privacy

Our Privacy Policy explains how we handle personal information and how to contact us with a privacy question or complaint.

10. Changes to these terms

We may update these terms and will publish the current version with its updated date. Changes will not retrospectively remove rights attached to an existing purchase. The terms accepted for an existing purchase continue to apply unless a change is required by law or is otherwise agreed with you.
